What To Know About Motorcycle Wrecks
APPALACHIAN AREA MOTORCYCLE WRECK ATTORNEYS
Summer is upon us and more motorcycles are going to hit the road, and if you are a biker, you’ve most likely already taken to the road several times. While motorcycles can be a ton of fun – – they can also be unsafe. If you’ve been injured in a motorcycle accident, our firm is here to help.
Do I have to wear a helmet?
This varies from state to state. In WV, VA, and TN, all riders are required to wear a helmet. In KY, riders under the age of 20 years are required to wear a helmet. If you are traveling to another state, you will need to check their laws. While you may not have to wear a helmet by law, we still advise you to do so, as it just may save your life. Further, failure to wear a helmet will be used against you by the insurance companies in an effort to minimize the amount they pay.
How do most motorcycle wrecks happen?
While motorcycle wrecks can be caused by a variety of factors, most are caused by negligence. Unfortunately, other motorists frequently fail to show motorcyclists the respect they deserve, often tailing them too closely, not letting them pass, and otherwise putting motorcyclists in danger. In other cases, motorcyclists are injured in dooring accidents, i.e. when people fail to look before opening their door and blocking a biker’s lane. Many motorcyclists are also hurt when people fail to look before merging or changing lanes.
How do I get compensated for my injuries?
To prevail on a claim, you and your legal team will have to gather and present evidence to prove that you were injured due to another party’s negligence. This is not always easy; some of the most helpful types of evidence include witness statements, a police report, medical documents, pictures of the collision, damage to vehicle, surveillance footage of the accident, and much more. Our firm is here to help in any way we can.
